Notice pursuant to Article 13 of Legislative Decree 196/2003

Data controller

The data controller is HERAmbiente S.p.A., whose registered offices are at 2/4 V.le Berti Pichat, 40127 Bologna (BO), in the person of its pro tempore legal representative.

Personal data collected

Personal data collected and processed by HERAmbiente S.p.A. for the purposes of managing correspondence with the company.

Processing operations

The following processing operations may be carried out on the data: collection, registration and organisation; storage, consultation, processing, modification, selection, extraction, comparison, usage, communication and deletion.

Purposes

Personal data are processed under the scope of routine company operations for purposes associated with and instrumental to the management of contacts, to comply with specific requests of the party concerned, for purposes connected with legal, regulatory and EU requirements as well as lawful provisions issued by the authorities; for functional reasons and activities for which the party concerned has the right to give or withhold their consent, and for sharing data with third parties for commercial purposes.
The party involved can obtain confirmation from the data processor of whether or not their personal data exist and for them to be made available in an intelligible format. The party involved can also ask to know the source of the data as well as the logic and purpose on which the processing is based, for the deletion, anonymisation or blocking of data processed in breach of the law, as well as the updating, amendment or, where said party has an interest therein, supplementing of the data, in addition to objecting, for legitimate reasons, to their processing (Article 7).

Personal data processed for commercial/marketing purposes

Pursuant to Articles 23 and 130 of Legislative Decree 196/2003, only with your consent, to be given at the foot of this notice, can certain personal data (forename, surname; email address; physical address; telephone numbers) be used for direct marketing purposes or offers of products and services through the use of automated call systems, electronic communications via electronic post, telefax, MMS (Multimedia Messaging Service) or SMS (Short Message Service), through telephone calls from an operator or the sending of promotional material via regular post and/or email.
We wish to stress that the interested party is entitled, at any time, to oppose the use of their personal data for promotional purposes as stated in the rights in Article 7 at the foot of this document.

Procedures

The data will be processed by letter, telephone or fax, as well as through automated IT systems, at the headquarters of the data controller, using procedures strictly related to the purposes set out above in order to ensure the security and confidentiality of the data.

Nature of the data provision

The provision of your personal data is free and optional but "any refusal to reply", at the time of the collection of the information, can lead to the objective impossibility for this company to provide the services requested.

Managers and Persons in charge of data processing

The data will be accessible to internal Managers and Persons in charge of data processing in the HERAmbiente S.p.A. Group.

Scope of data communication

The data will also be accessible to external Managers who need to have access to the data to carry out the job with which they have been tasked, e.g. service and contact centre, IT systems management, document transmission. The company can also call upon Hera Spa and other Hera Group companies under the limits of the purposes previously indicated.

Scope of data disclosure

Your data are not, however, subject to disclosure.

Duration of the data processing

Your data will be processed for the time strictly necessary to carry out the services requested by you.

Rights pursuant to Article 7 of Legislative Decree 196/2003

The law grants you specific rights. Specifically, you can exercise the rights pursuant to Article 7 of Legislative Decree 196/2003 (reported below in full) by sending an email to the following address: Privacy.Herambiente@gruppohera.it.

Article 7, Legislative Decree 196/2003
(Right to access personal data and other rights)

1. The interested party is entitled to obtain confirmation of whether or not personal data concerning him/her exist, regardless of whether such data have already been recorded, and to have such data communicated to him/her in an intelligible form.
2. The interested party is entitled to be informed of:
a) the source of the personal data;
b) the purposes of and procedures involved in the data processing;
c) the logic applied to data processing carried out using electronic tools;
d) the details of the data controller, the data processors and the designated representative pursuant to Article 5, paragraph 2;
e) the persons or categories of persons to which the personal data may be communicated or which may become aware of the personal data in the capacity of designated representative in the state's territory, the data processor or the person in charge of data processing.
3. The interested party is entitled to obtain:
a) the updating, amendment or, where said party has an interest therein, supplementing of the data;
b) the deletion, anonymisation or blocking of data processed in breach of the law, including data which it is not necessary to store in relation to the purposes for which the data have been collected or subsequently processed;
c) proof that the operations referred to in letters a) and b) and the content thereof have been brought to the attention of those to whom the data have been communicated or disseminated, except in cases where the provision of said proof is impossible or involves the use of means that are clearly disproportionate to the protected right.
4. The interested party is entitled to oppose, in full or in part:
a) for legitimate reasons, the processing of personal data concerning him/her, even if pertinent to the purpose of the data collection;
b) the processing of personal data concerning him/her for the purposes of sending advertising or direct-sales material or for carrying out market research or commercial communications.
